Terms of service

These terms govern use of the Sunhail service by hotels and their staff (“you”). By creating or using a staff account you agree to them. Guests ordering at a hotel aren't party to these terms — their relationship is with the hotel.
1 · The service
Sunhail provides software for taking, managing and billing poolside food-and-drink orders: guest QR ordering, fulfilment boards, a staff order pad, guest-list validation, room-bill aggregation, and management tools. We host it, keep it running, and improve it — features may evolve, but not in ways that meaningfully reduce what you're paying for (pilots: what you've been offered).
2 · Your side of the deal
- You're responsible for what you sell: menu accuracy, pricing, allergen and ingredient information, and compliance with the laws that govern your venue — including alcohol licensing and responsible service.
- You control who gets staff accounts, and you'll keep credentials personal and confidential. Actions taken under an account are the hotel's actions.
- Guest-list data you load into Sunhail is data you're entitled to process, and our privacy policy describes how we handle it for you.
- Payments are settled through your own till, card machine or property-management system. Sunhail records payment intent and totals; it does not move money.
3 · Acceptable use
Don't attempt to break, probe or overload the service; don't use it to store content that is unlawful or that you have no right to hold; don't resell access without an agreement with us. We may suspend accounts that put the service or its users at risk, and we'll tell you when we do.
4 · Availability
We aim for the service to be available throughout your service hours and design it to degrade gracefully (the bar board reconnects and catches up after network drops). Planned maintenance happens outside typical pool hours where possible. The service is provided “as is” during pilots.
5 · Your data
The hotel owns its data — menu, guest lists, orders, records. On termination we'll provide an export of your data on request and then delete it from production systems within 30 days, except where law requires retention.
6 · Intellectual property
Sunhail owns the software; you own your content (names, logos, menus, photos) and grant us the licence needed to display it to your guests and staff — that's the whole use.
7 · Liability
Nothing here limits liability that cannot lawfully be limited. Otherwise, neither party is liable for indirect or consequential loss, and our total liability in any twelve-month period is capped at the amounts you paid for the service in that period (for free pilots, a nominal £100). Food-and-beverage operations remain the hotel's responsibility.
8 · Ending things
Pilots can end at any time by either side with notice in writing (email is fine). Paid terms will say their own notice periods when they exist.
9 · The boring but important bits
These terms are governed by the law of England and Wales, with the courts of England and Wales having exclusive jurisdiction. If we materially change these terms we'll notify hotels directly; continued use after notice is acceptance. Questions: ozzieintheuk@gmail.com.
